1. Definitions

In these Terms and Conditions, the following terms have the meanings set out below:

• "Agreement" means these Terms and Conditions together with any written scope and fee agreement entered into by the parties.
• "We", "Us", "Our" means Sai Yai Law, a professional law practice registered and operating in Bangkok, Thailand.
• "You", "User" means any person who accesses this website or who engages our services.
• "Services" means the family law services described on this website, including Adoption Documentation Review, Guardianship Application Support, and International Family Coordination.
• "Website" means this website operated by Sai Yai Law at saiyaily.biz.
• "Engagement Agreement" means the written scope and fee agreement signed before any Service commences.

2. Acceptance of these terms

By accessing this website, you agree to be bound by these Terms and Conditions. Use of the website constitutes acceptance. If you do not agree, please do not use this website.

Engagement of our Services is subject to a separate written Engagement Agreement, which must be signed by both parties before any work commences. These Terms and Conditions apply to website use; the Engagement Agreement governs the service relationship.

You must be at least 18 years old and have legal capacity to enter into a binding agreement to engage our Services.

3. Services described on this website

Sai Yai Law provides specialist family law services in three areas: adoption documentation review, guardianship application support, and international family coordination. These services are described in general terms on this website. The precise scope of any service for a particular matter is set out in the Engagement Agreement.

Services are provided from our Bangkok office. We are able to assist clients who are based outside Thailand where their matter has a Thai legal element or an international coordination element that we are equipped to handle.

Information on this website is provided for general reference and does not constitute legal advice. Specific legal advice is given only under the terms of a signed Engagement Agreement.

4. Your responsibilities

When using this website, you agree to:

• Provide accurate information when submitting the enquiry form.
• Not use this website for any unlawful purpose or in any way that could damage, disable, or impair it.
• Not attempt to gain unauthorised access to any part of this website or its supporting systems.
• Not submit information that is false, misleading, or belongs to another person without authority.

Where you engage our Services, you also agree to provide accurate and complete information relevant to your matter, and to inform us promptly of any change that may affect the matter.

5. Intellectual property

All content on this website — including text, design, and structure — is the property of Sai Yai Law and is protected under Thai copyright law. You may read and print content for your own personal, non-commercial reference. You may not reproduce, distribute, or republish any part of this website without our prior written consent.

Written work product produced by Sai Yai Law under an Engagement Agreement (including review notes, application drafts, and coordination records) is provided for your use in connection with the matter for which it was prepared. Rights in that work product are addressed in the Engagement Agreement.

6. Fees and payment

Service fees are stated in Thai Baht (THB) and are set out in the Engagement Agreement before any work commences. The fees published on this website are indicative of the fees applicable to matters within the described scope; they are confirmed in the Engagement Agreement for each specific matter.

Payment terms are set out in the Engagement Agreement. Where payment is required in advance of work commencing, this will be stated explicitly.

Scope changes: Where a matter develops beyond the agreed scope, we will notify you in writing and agree a further fee before proceeding. No additional fees will be incurred without your written agreement.

Refunds: Where a service has been commenced and you wish to discontinue, fees for work already carried out are not refundable. Where a service has not yet commenced, fees paid in advance will be returned less any administrative costs, as set out in the Engagement Agreement.

7. Service delivery

Sai Yai Law will carry out the agreed Services with reasonable professional care and skill. We will communicate progress in writing at each meaningful step, as described in the Engagement Agreement and on this website.

Timelines are indicative where given and depend in part on factors outside our control, including the availability of third-party authorities, assessors, and counterpart practitioners. We will notify you of any material delay.

Where our Services involve coordination with foreign practitioners or authorities, we act as coordinator and communicator on your behalf. We do not provide legal advice under foreign law; where foreign legal advice is required, this will be noted in the Engagement Agreement and, where appropriate, referred to a qualified practitioner in the relevant jurisdiction.

8. Disclaimers

This website and its contents are provided for informational purposes and do not constitute legal advice. General information about family law matters in Thailand is provided in good faith but may not reflect recent changes in law or procedure. You should not act on website content alone without seeking specific advice relevant to your situation.

The outcome of any legal matter depends on facts, circumstances, and decisions made by third parties, including courts and government authorities. Sai Yai Law does not represent that any particular outcome will result from the engagement of our Services.

We make reasonable efforts to keep this website accurate and up to date but do not warrant that it is free from error or omission at any given time.

9. Limitation of liability

To the extent permitted by Thai law, Sai Yai Law's liability in connection with Services provided under an Engagement Agreement is limited to the fee paid for the specific Service to which the claim relates.

We are not liable for indirect, consequential, or incidental losses arising from the use of this website or from the Services, including loss of opportunity or loss arising from decisions made by third-party authorities.

Nothing in these Terms limits liability for fraud, wilful misconduct, or death or personal injury caused by negligence.

10. Confidentiality

Information shared with Sai Yai Law in connection with an enquiry or a Service engagement is treated as confidential and will not be disclosed to third parties except where necessary to carry out the Service (for example, communicating with a relevant authority on your behalf) or where required by law. Our full approach to personal information is set out in our Privacy Policy.

11. Termination of engagement

Either party may terminate an Engagement Agreement by written notice. The consequences of termination, including the treatment of fees and work in progress, are set out in the Engagement Agreement.

Sai Yai Law may decline to continue an engagement where doing so would conflict with our professional obligations or where the information provided by the client proves to be materially inaccurate. In such circumstances, fees for work already completed will be retained.

12. Governing law and dispute resolution

These Terms and Conditions and any Engagement Agreement are governed by the laws of Thailand.

In the event of a dispute, we ask that you contact us first in writing at [email protected] to allow us the opportunity to address your concern informally. We aim to respond to any written concern within 10 working days.

Where a dispute cannot be resolved informally, the parties agree to submit to the non-exclusive jurisdiction of the courts of Bangkok, Thailand.

13. General provisions

• Entire agreement: These Terms, together with any signed Engagement Agreement, constitute the entire agreement between the parties in relation to website use and service delivery.
• Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force.
• Waiver: Failure to enforce any provision on a given occasion does not constitute a waiver of that provision on future occasions.
• Assignment: You may not assign rights or obligations under these Terms or under an Engagement Agreement without our written consent. We may assign our rights and obligations with written notice to you.
• Notices: Formal notices under these Terms should be sent in writing to our address below or to [email protected].

14. Changes to these terms

We may update these Terms from time to time. Changes take effect from the date shown at the top of this page. Continued use of this website after that date constitutes acceptance of the updated Terms. Material changes will be flagged at the top of this page with a revised effective date.
